Identifying Heirs and the Estate

Before calculating inheritance entitlements, establish the deceased owner's assets, debts, personal law and full list of surviving heirs. Shares cannot safely be determined from a generic family example.

Succession Documentation

Depending on the asset, heirs may need succession-related certificates, letters of administration, authenticated records or other documentation. The process and the competent authority depend on the applicable law and asset type.

Inheritance Mutation and Ownership Records

Revenue and property authority records may require updating after death. Such entries should be distinguished from the substantive rights inherited by lawful heirs.

Partition of Jointly Inherited Property

Co-heirs may negotiate a documented settlement. If division is contested, appropriate partition proceedings before a court or revenue authority may be necessary, depending on the property.

Unauthorised Sales and Excluded Heirs

Where an heir alleges that a property was sold without lawful authority or their share was withheld, the documents, chain of title, dates, possession and available relief must be examined. Possible claims include declaration, partition, cancellation and recovery, subject to law and evidence.

Overseas Heirs and Representation

An overseas heir may need guidance about powers of attorney, authentication, records and representation in Pakistan. Document requirements and legal authority should be checked before delegation.
